BACKGROUND:
This agreement applies as between you, the User of this Web Site and Rise2fame the owner(s) of this Web Site. Your agreement to comply with and be bound by these Terms and Conditions is deemed to occur upon your first use of the Web Site. If you do not agree to be bound by these Terms and Conditions, you should stop using the Web Site immediately.
1. Definitions and Interpretation
In this Agreement the following terms shall have the following meanings:
“Account” means collectively the personal information, Payment Information and credentials used by Users to access Paid Content and / or any communications System on the Web Site;
“Content” means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Web Site;
“Rise2fame” means Rise2fame, Rise2fame.com, Rise2fame.co.uk
“Service” means collectively any online facilities, tools, services or information that Rise2fame makes available through the Web Site either now or in the future;
“Services” means the services available to you through this Web Site
“Payment Information” means any details required for the purchase of Services from this Web Site. This includes, but is not limited to, credit / debit card numbers, bank account numbers and sort codes;
“System” means any online communications infrastructure that Rise2fame makes available through the Web Site either now or in the future. This includes, but is not limited to, web-based email, message boards, live chat facilities and email links;
“User” / “Users” means any third party that accesses the Web Site and is not employed by Rise2fame and acting in the course of their employment; and
“Web Site” means the website that you are currently using (Rise2fame.com and any sub-domains of this site e.g. sub-domain. Rise2fame .co.uk) unless expressly excluded by their own terms and conditions.
These Terms and Conditions apply to Both Subscribing and non-subscribing members.
2. Intellectual Property
2.1 Subject to the exceptions in Clause 4 of these Terms and Conditions, all Content included on the Web Site, unless uploaded by Users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of Rise2fame our affiliates or other relevant third parties. By continuing to use the Web Site you acknowledge that such material is protected by applicable United Kingdom and International intellectual property and other laws.
2.2 Subject to Clause 5 you may not reproduce, copy, distribute, store or in any other fashion re-use material from the Web Site unless otherwise indicated on the Web Site or unless given express written permission to do so by Rise2fame
3. Links to Other Web Sites
This Web Site may contain links to other sites. Unless expressly stated, these sites are not under the control of Rise2fame or that of our affiliates. We assume no responsibility for the content of such web sites and disclaim liability for any and all forms of loss or damage arising out of the use of them. The inclusion of a link to another site on this Web Site does not imply any endorsement of the sites themselves or of those in control of them. You further acknowledge and agree that rise2fame.com shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of, or reliance upon, any such Content, goods or services available on or through any such site or resource.
4. Links to this Web Site Those wishing to place a link to this Web Site on other sites may do so only to the home page of the site rise2fame.com without prior permission. Deep linking (i.e. links to specific pages within the site) requires the express permission of Rise2fame to find out more please contact us by email at info@rise2fame.com.
5. Use of Communications Facilities
5.1 When using the member comments, contact forms or any other System on the Web Site you should do so in accordance with the following rules:
5.1.1 You must not use obscene or vulgar language;
5.1.2 You must not submit Content that is unlawful or otherwise objectionable. This includes, but is not limited to, Content that is abusive, threatening, harassing, defamatory, ageist, sexist or racist;
5.1.3 Rise2fame is not responsible for the content, and makes no warranty as to the accuracy of Members’ personal information. Advertisers should always use their own judgement in deciding whether to contact, cast or audition members. We shall not be liable under any circumstances for the actions of any Member;
5.1.4 The means by which you identify yourself must not violate these terms of use or any applicable laws;
5.1.5 You must not impersonate other people, particularly employees and representatives of Rise2fame or our affiliates; and
5.1.6 You must not use our System for unauthorised mass-communication such as “spam” or “junk mail”.
5.2 You acknowledge that Rise2fame reserves the right to monitor any and all communications made to us or using our System.
6. Accounts
6.1 In order to procure Services on this Web Site and to use the facilities you are required to create an Account which will contain certain personal details and Payment Information which may vary based upon your use of the Web Site. By continuing to use this Web Site you represent and warrant that:
6.1.1 all information you submit is accurate and truthful;
6.1.2 you have permission to submit Payment Information where permission may be required; and
6.1.3 You will keep this information accurate and up-to-date.
Your creation of an Account is further affirmation of your representation and warranty.
6.2 It is recommended that you do not share your Account details, particularly your username and password. RISE2FAME accepts no liability for any losses or damages incurred as a result of your Account details being shared by you. If you use a shared computer, it is recommended that you do not save your Account details in your internet browser.
6.3 If you have reason to believe that your Account details have been obtained by another without consent, you should contact RISE2FAME immediately to suspend your Account and cancel any unauthorised payments that may be pending. Please be aware that payments can only be cancelled up until provision of Services has commenced. In the event that an unauthorised provision commences prior to your notifying us of the unauthorised nature of the payment, Rise2fame accepts no liability. When choosing your username you are required to adhere to the terms set out above in Clause Any failure to do so could result in the suspension and/or deletion of your Account.
7. Termination and Cancellation
7.1 Either Rise2fame or you may terminate your Account. If Rise2fame terminates your Account, you will be notified by email and an explanation for the termination will be provided. Notwithstanding the foregoing, we reserve the right to terminate without giving reasons.
7.2 If Rise2fame terminates your Account, any current or pending orders or payments on your Account will not be cancelled and provision of Services will not commence.
7.3 Rise2fame reserves the right to cancel orders or payments without stating reasons, for any reason prior to processing payment or commencing Services provision.
7.4 It is the responsibility of the subscribing member to cancel their subscription PRIOR to their renewal date through their PayPal account. If an upgraded member fails to cancel their subscription(s) directly through PayPal, Rise2fame will not be responsible for past or future billings
8. Subscription
8.1 Rise2fame is a part subscription service, all subscriptions are automatically renewed at the end of each subscription payment term, rise2fame.Com uses PayPal.com as its third party payment system; each user is responsible to review and abide by the rules set out by PayPal.
8.2 General. The fees payable in respect of the Service shall be those fees as set out on the website from time to time. We reserve the right to vary the fees in accordance with these terms and conditions
8.3 You agree to pay Rise2fame all charges at the prices then in effect for any use of the Service by you or other persons using your Billing Account, and you authorize Rise2fame to charge your chosen payment provider (your "Payment Method") for the Service. You agree to make payment using that selected Payment Method.
8.4 Subscriptions renew according to the payment term chosen by the member. Recurring Billing Most subscription plans to the Service consist of an initial period, for which there is a onetime charge, followed by recurring period charges as agreed to by you. By entering into this Agreement, you acknowledge that your subscription has an initial and recurring payment feature and you accept responsibility for all recurring charges prior to cancellation. Please note that PayPal does not send advance notice of PayPal subscription renewals, therefore it is the responsibility of any upgraded member to keep a record of their subscription date and subsequent renewal dates.
8.5 Reaffirmation of Authorization. Your non-termination or continued use of the Service reaffirms that Rise2fame is authorized to charge your Payment Method. Rise2fame may submit those charges for payment and you will be responsible for such charges. This does not waive Rise2fame’s right to seek payment directly from you. Your charges may be payable in advance, in arrears, per usage, or as otherwise described when you initially subscribed to the Service
REFUND POLICY: Because of the immediate access nature of the internet and our website, we have a no-refund policy, since subscribing member gets immediate and full access to the site and its services and/or products. Since you cannot physically return an e-book or the member services of an online portfolio, we do not give refunds.
9. Provision of Services .
9.1 Rise2fame is a free platform for individuals with creative instincts and innate talents to showcase their work/portfolio in order to get discovered.
9.2 Provision of Services shall commence when an Account has been created or as otherwise detailed in the Terms & Conditions pertaining directly to those Services
9.3 Rise2fame shall use its best endeavours to provide the Services with reasonable skill and care.
9.4 Provision of all Services shall be subject to the terms and conditions pertaining directly to those Services.
9.5 Rise2fame reserves the right to exercise discretion with respect to any alterations to Services under the provisions of this Clause Factors which may be taken into account in the exercise of this discretion include, but are not limited to:
9.5.1 Any use or enjoyment that you may have already derived from the Services;
9.5.2 Any characteristics of the Service which may mean that cessation of provision is impossible without significant further work on the part and at the expense of Rise2fame.
Such discretion to be exercised only within the confines of the law.
10. Member contact
10.1 You agree that when you make your profile public or include your photo in the talent directory that Rise2fame will publish your personal information and photos, and allow classified members to contact you. You also agree that you will not use the contact system to send junk mail, spam, offensive messages, or for any purposes other than those directly related to auditions or casting calls. Any breach of these conditions can result in your membership being terminated and a permanent ban from the site without with/without notice. No refund will be given if you have breached the conditions of use.
10.2 The Promotion and Recruitment of Escorts, Escort Services, Personal Companions, (etc.) are contrary to the purposes of Rise2fame, and will not be tolerated in any fashion. Soliciting for, recruiting, or offering the services of escorts on this site is strictly prohibited. Portfolios that are used for the solicitation or promotion of escort services in ANY way will be immediately disabled with no refund. This includes (but is not limited to): Use of the referral system, hyperlinks to external sites promoting escorts, URLs (web addresses) promoting escorts and any other activity that the staff of Rise2fame deems as solicitations, promotions, or offers.
10.3 Rise2fame has a stated policy regarding the posting of sexually explicit images to its web pages. Sexually explicit images are not permitted on this site. Sexually explicit images include but are not limited to images of sexual intercourse, obvious states of sexual arousal (erections), or overt sexual positions (such as noticeably visible or spread genitalia). Failure to adhere to this restriction will result in the removal of the images, and the disablement of that member portfolio. Consistent misclassification (rating) or categorization of images may result in the forced setting of ratings and in gross violations may result in the removal of your portfolio.
11. Responsibility for Minors
11.1 If you are 13 years or younger, you must have a parent, or a legal guardian enter and approve all information, and ensure that the parent or legal guardian's email address and contact information is used at all times. Rise2fame reserves the right to change and modify these usage rules as appropriate and without notice.
11.2 In accordance with the Children's Online Privacy Protection Rule you as the parent or guardian of a minor under the age of 13 have read and agree to the terms of use and take full responsibility for the minor based on the information provided when creating an accounts and you agree that those information can be displayed publicly for the purposes of casting agents to view and contact the minor for castings.

13. Disclaimers
13.1 Rise2fame makes no warranty or representation that the Web Site will meet your requirements, that it will be of satisfactory quality, that it will be fit for a particular purpose, that it will not infringe the rights of third parties, that it will be compatible with all systems, that it will be secure and that all information provided will be accurate. We make no guarantee of any specific results from the use of our Service or Services.
13.2 No part of this Web Site is intended to constitute advice and the Content of this Web Site should not be relied upon when making any decisions or taking any action of any kind.
13.3 No part of this Web Site is intended to constitute a contractual offer capable of acceptance.
14. Changes to Rise2fame and the Terms of Service.
We reserve the right, at our sole discretion, to change, modify, add, or delete portions of these Terms of Service at any time without further notice. If we do this, we will post the changes to these Terms of Service on this page and we may send registered users an email notifying you of the change.
14. IF ANY MODIFICATION IS UNACCEPTABLE TO YOU, YOU SHALL STOP USING THE RISE2FAME SERVICE. YOUR CONTINUED USE OF THE RISE2FAME SERVICE FOLLOWING OUR POSTING OF A CHANGE NOTICE OR NEW AGREEMENT ON OUR SITE OR RECEIVING OUR EMAIL NOTIFYING YOU OF THE CHANGE WILL CONSTITUTE YOUR BINDING ACCEPTANCE OF THE CHANGE.
15. Availability of the Web Site
15.1 The Service is provided “as is” and on an “as available” basis. We give no warranty that the Service will be free of defects and / or faults. To the maximum extent permitted by law we provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality.
15.2 Rise2fame accepts no liability for any disruption or non-availability of the Web Site resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.
16. Liability
16.1You Agree that, to the maximum extent permitted by law, any and all liability and responsibility of Rise2fame to you or any other person under or in connection with these terms and conditions, or in connection with the services, this web site, another member's acts or omissions, or your use of or inability to use, the services or this web site is excluded regardless of whether such liability arises in contract, tort (including negligence), equity, breach of statutory duty or otherwise.
16.2 Rise2fame accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, without limitations, consequential, special or exemplary damages arising from the use of the Web Site or any information contained therein. Users should be aware that they use the Web Site and it’s Content at their own risk.
16.3 You agree to release, indemnify and keep indemnified us from and against all actions, claims, costs (including legal costs and expenses) losses, proceedings, damages, liabilities, or demands suffered or incurred by us to any person arising out of or in connection with your use of our services.

These terms and conditions and the relationship between you and Rise2fame shall be governed by and construed in accordance with all applicable local, state, national and International Laws and regulations.
VIOLATION OF THESE TERMS AND CONDITIONS WILL CAUSE YOUR MEMBERSHIP TO BE TERMINATED WITHOUT A REFUND.
